1. Introduction
Welcome to Safeticha. These Terms of Service ("Terms") govern your access to and use of the Safeticha platform, including our website, mobile applications, and all related services. By accessing or using Safeticha, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our platform.
Safeticha is operated by Safeticha Ltd, a company registered in the Federal Republic of Nigeria. These Terms constitute a legally binding agreement between you and Safeticha Ltd. Please read them carefully before using our services.
2. Definitions
For the purposes of these Terms, the following definitions apply:
- "Platform" means the Safeticha website located at safeticha.com, our mobile applications, and all associated services, tools, and features.
- "User" means any individual or entity that accesses or uses the Platform, whether as a registered or unregistered visitor.
- "School" means an educational institution that has registered on Safeticha to manage its academic and administrative operations.
- "Content" means any materials, resources, data, text, images, videos, or other information uploaded, submitted, generated, or otherwise made available through the Platform.
- "Ticha AI" means Safeticha's proprietary artificial intelligence assistant and content generation tool.
- "AI Coins" means the virtual currency used within the Platform to access Ticha AI features and services.
3. Account Registration
To access certain features of the Platform, you must create an account. When registering, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
The Platform supports the following account types:
- School accounts — for educational institutions to manage administration, teachers, students, and academic operations.
- Teacher accounts — for educators to access teaching tools, sell resources, apply for jobs, and use Ticha AI.
- Parent accounts — for parents and guardians to monitor their children's academic progress and communicate with schools.
- Student accounts — for learners to access practice questions, exam preparation materials, and academic resources.
Users must be at least 18 years of age to create an account independently. Users under 18 may only use the Platform with the consent and supervision of a parent or legal guardian. Schools are responsible for ensuring appropriate parental consent is obtained for student accounts created under their administration.
You must notify us immediately of any unauthorised use of your account or any other breach of security. Safeticha shall not be liable for any loss or damage arising from your failure to comply with this requirement.
4. Platform Services
Safeticha provides a comprehensive suite of educational technology services designed for African schools, teachers, parents, and students. Our services include:
- School Intelligence Dashboard — A centralised management system enabling schools to oversee academic operations including attendance tracking, grade management, behaviour monitoring, timetable scheduling, staff management, and communications.
- Ticha AI — An AI-powered assistant that helps educators generate lesson plans, schemes of work, assessments, report card comments, and other teaching materials tailored to African curricula.
- Resource Marketplace — A digital marketplace where teachers can upload, sell, and purchase educational resources including lesson notes, worksheets, activities, and assessment materials.
- Teaching Jobs Board — A recruitment platform connecting schools with qualified teaching professionals, enabling schools to post vacancies and teachers to discover and apply for opportunities.
- Practice & Exam Prep — A subscription-based service providing students with practice questions, mock examinations, and exam preparation tools for standardised tests including WAEC, NECO, JAMB, and school-level assessments.
- Parent Portal — A dedicated area for parents and guardians to view their children's academic performance, attendance records, behaviour reports, and school communications.
- Student Portal — A personalised learning environment where students access their assignments, grades, practice materials, and learning resources.
Safeticha reserves the right to modify, suspend, or discontinue any part of the services at any time, with reasonable notice where practicable.
5. Subscription & Billing
Certain services on Safeticha require a paid subscription. By subscribing, you agree to the following billing terms:
- School subscriptions are billed on a monthly or annual basis via the Safeticha wallet system. Schools must maintain a sufficient wallet balance to cover subscription charges. If the wallet balance is insufficient at the time of renewal, a 7-day grace period will be provided before the subscription is suspended. During the grace period, limited functionality may apply.
- Practice & Exam Prep subscriptions are billed monthly via wallet top-up or Paystack auto-recurring payment. Practice subscriptions expire immediately if the wallet balance is insufficient at the time of renewal. There is no grace period for practice subscriptions.
- No refunds will be issued for used subscription periods. If you cancel a subscription mid-cycle, you will retain access to the service until the end of the current billing period, after which the subscription will not renew.
- AI Coins are a virtual currency used to access Ticha AI features. AI Coins are non-transferable between accounts and non-refundable once purchased. Unused AI Coins remain in your account indefinitely, subject to account activity requirements.
All payments are processed securely through Paystack or our wallet system. Safeticha does not directly store your payment card details. Pricing is displayed in the applicable local currency and may be updated from time to time with reasonable notice.
6. Resource Marketplace
The Safeticha Resource Marketplace enables teachers and educational professionals to sell and purchase teaching resources. The following terms govern marketplace transactions:
- Ownership: Sellers retain full ownership of the original content they upload to the Marketplace. By listing a resource, sellers grant Safeticha a non-exclusive licence to display, distribute, and promote the resource on the Platform.
- Commission: Safeticha charges a 20% commission on the sale price of each resource sold. The remaining 80% of proceeds will be credited to the seller's account.
- Seller obligations: Sellers must be the original author or have the legal right to sell the resources they list. Sellers represent and warrant that their resources do not infringe upon the intellectual property rights of any third party.
- Buyer licence: When purchasing a resource, buyers receive a personal-use licence to download and use the resource for their own educational purposes. Buyers do not acquire ownership of the resource and may not resell, redistribute, or commercially exploit purchased resources without the seller's written consent.
The following content is strictly prohibited on the Marketplace:
- Resources that violate intellectual property rights, including unauthorised or unlicensed use of copyrighted material.
- Content that is illegal, harmful, discriminatory, offensive, or inappropriate for the intended educational audience.
- Resources containing sensitive information, including personal information of children or confidential data.
- Content that promotes violence, hatred, or illegal activities.
Safeticha reserves the right to review, suspend, or remove any resource that violates these terms or is deemed inappropriate for sale on the Platform. Repeated violations may result in account suspension or termination.
7. Intellectual Property
The Safeticha platform, including its design, branding, logos, software, underlying technology, and AI models, is the exclusive intellectual property of Safeticha Ltd. All rights not expressly granted in these Terms are reserved.
Users retain ownership of their original content uploaded to the Platform, including teaching resources, documents, and other materials they create independently. By uploading content, users grant Safeticha a non-exclusive, worldwide licence to host, display, and distribute the content as necessary to provide the services.
Content generated using Ticha AI is subject to the following: users own the specific output produced through their use of Ticha AI and may use it freely for their educational purposes. However, Safeticha retains all rights to the underlying AI models, algorithms, templates, and structures that power Ticha AI. Users may not reverse-engineer, decompile, or attempt to extract the underlying technology.
8. Privacy
Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms. By using the Platform, you acknowledge that you have read, understood, and agree to the practices described in our Privacy Policy.
We collect and process personal data as necessary to provide and improve our services, including account information, usage data, payment information, and educational records. For full details on what data we collect, how we use it, and your rights, please refer to our Privacy Policy.
9. Acceptable Use
You agree to use the Platform only for lawful purposes and in accordance with these Terms. The following conduct is strictly prohibited:
- Attempting to gain unauthorised access to the Platform, other user accounts, or any systems or networks connected to the Platform (hacking).
- Using automated tools, bots, scrapers, or crawlers to extract data from the Platform without prior written consent.
- Impersonating any person or entity, or falsely representing your affiliation with any person or entity.
- Harassing, abusing, threatening, or intimidating other users of the Platform.
- Uploading or transmitting viruses, malware, or any harmful or destructive code.
- Uploading content that is illegal, obscene, defamatory, or otherwise objectionable.
- Circumventing or attempting to circumvent any access controls, billing mechanisms, or usage limits on the Platform.
- Using the Platform to send unsolicited communications, spam, or promotional materials.
- Interfering with the proper functioning of the Platform or disrupting the experience of other users.
Safeticha reserves the right to investigate and take appropriate action against any user who violates these acceptable use provisions, including suspending or terminating their account and reporting illegal activity to law enforcement authorities.
10. Safeguarding
Safeticha is committed to the safety and wellbeing of children and young people who interact with our Platform. However, schools and educational institutions registered on the Platform are solely responsible for developing, implementing, and enforcing their own safeguarding policies in accordance with applicable local laws and regulations.
While Safeticha provides tools that may assist schools in monitoring student behaviour and welfare (such as behaviour logging and reporting features), these tools do not replace professional safeguarding oversight, qualified designated safeguarding leads, or institutional child protection procedures.
Users who become aware of any safeguarding concerns must report them through the proper institutional channels and to the relevant authorities as required by law. Safeticha should not be used as a substitute for emergency services or official safeguarding reporting mechanisms.
11. Limitation of Liability
The Platform and all services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Safeticha does not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components. We make reasonable efforts to ensure the availability and reliability of our services, but we do not guarantee continuous or secure access at all times.
To the maximum extent permitted by applicable law, Safeticha Ltd, its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption, arising out of or in connection with your use of the Platform.
In any event, Safeticha's total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the Platform shall not exceed the total amount of fees paid by you to Safeticha during the twelve (12) months immediately preceding the event giving rise to the claim.
12. Termination
Either party may terminate the relationship governed by these Terms at any time. You may close your account by contacting us at hello@safeticha.com or through the account settings on the Platform.
Safeticha reserves the right to suspend or terminate your account, in whole or in part, at any time and without prior notice if:
- You breach any provision of these Terms.
- We reasonably believe your conduct may cause harm to other users, the Platform, or third parties.
- We are required to do so by law or legal process.
- Your account has been inactive for an extended period.
Upon termination, your right to access the Platform ceases immediately. Access to content stored on the Platform, including uploaded resources, student data, and generated materials, may no longer be available after termination. We recommend exporting any important data before closing your account. Termination does not relieve you of any obligations incurred prior to the termination date, including outstanding payments.
13. Changes to Terms
Safeticha reserves the right to update, modify, or replace these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. For material changes that significantly affect your rights or obligations, we will make reasonable efforts to notify you via email or through a prominent notice on the Platform.
Your continued use of the Platform following the posting of revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Platform and close your account.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions.
Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall first be settled through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, it shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Mediation Act of Nigeria. The seat of arbitration shall be Lagos, Nigeria, and the language of arbitration shall be English.
